The Effects of Disbelief between Contracts and Rhythms

Abstract
This study explores the jurisprudential implications of disbelief (kufr) on Islamic legal contracts and enactments. It examines how both major and minor forms of disbelief impact the validity of transactions such as sales, leases, and marriages, as well as legal actions like divorce and manumission. By analyzing classical scholarly opinions and Islamic legal texts, the research differentiates between original disbelief and apostasy, and clarifies their respective legal consequences. The study also addresses the legitimacy of contracts executed by non-Muslims in Islamic and non-Islamic territories, offering a balanced jurisprudential perspective relevant to contemporary multi-faith societies.
